as Owner, owns and operates a baseball batting cage at Shawnee Kansas 66216. Johnson County

Whereas the undersigned

Whereas, Owner requires that this Waiver and Release be executed as a condition of using the Cage.
Now, therefore, for and in consideration of using the Cage, and other good and valuable consideration. the receipt and sufficiency of which is hereby acknowledged, Participant agrees to the following
The undersigned Participant does hereby waive and release, indemnify, hold harmless and forever discharge Owner and his agents employees, officers, directors, affiliates, successors and assigns (hereinafter called Releases), of and from any and all claims, demands, debts, contracts, expenses. causes of action, lawsuits, damages and liabilities, of every kind and nature, whether known or unknown, in law or equity, that Participant ever had or may have, arising from or in any way related to use of the Cage, today, or on any future date
The undersigned Participant understands that the activities that he/she will participate in can be dangerous
and may cause serious or grievous injuries, including bodily injury and/or death. However, the undersigned Participant waives all claims for damages, injuries and death sustained by Participant that he she may have or hereafter acquire against Releases as a result of using the Cage.
By execution of this Waiver and Release. Participate assumes any risk, and takes full responsibility and
waives any claims of personal injury or death associated with using the Cage
This Waiver and Release contains the entire agreement between the parties, and supersedes any prior
written or oral agreements between them concerning the subject matter of this Waiver and Release
The provisions of this may be waived, altered, amended or repealed, in whole or in part, only upon the prior
written consent of all parties
Participant acknowledges that he/she has read, understands and fully agrees to the terms of this Waiver and
Release and understands and confirms that by signing this Waiver and Release, he/she has possibly given up considerable future legal rights
Participant has signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to Participant, Participant certifies that he/she is 18 years of age or older and mentally competent to enter into this Waiver and Release
